Who Qualifies for Expungement in California?

Not everyone is eligible for expungement. The following must be true: 

  • You completed probation successfully, or you were discharged early.
  • You have not been convicted of any new crimes since your conviction.
  • You are not currently charged with a new offense.
  • Your conviction was not for certain serious or violent felonies that are excluded by law.

Felony convictions may be eligible for expungement if the felony has been reduced to a misdemeanor or if you have completed probation. Some felonies, such as certain sex offenses or serious violent crimes, are not eligible for expungement.
